Update on proposed UKCA ‘Ex’ (ATEX) legislation amendment

 

In June 2022, the UK government announced proposed changes to the UKCA EX (ATEX) legislation to simplify the requirements for manufacturers placing ‘Ex’ product on to the UK market.

For these proposed changes to take effect, an amendment to the existing legislation is required. This amendment was published on the 6th of September but was then withdrawn on the 10th of October 2022.

Unless the UK Government proposes new legislation and gets it passed through Parliament before the 21 Dec 2022 you will need a UKCA Government Appointed Body Certificate (where you needed an ATEX Notified Body Certificate for the EU) from 1st Jan 2023.
